President of Russia Signs Federal Law “Concerning Amending Certain Legislative Acts of the Russian Federation on the Issues of Authorization to Operation of Power Installations
The President of the Russian Federation signed the Federal Law dated April 24, 2020, No. 141-FZ “Concerning Amending Certain Legislative Acts of the Russian Federation on the Authorization to Operation of Power Installations.” The draft federal law was developed by Federal Environmental, Industrial and Nuclear Supervision Service.
The federal law introduces amendments to the federal laws “Concerning electric power industry” and “Concerning heat supply,” which regulate the issues of obtaining permits authorizing the operation of electric power and heat supply facilities, and power receiving and heat-consuming installations.
In accordance with the federal law, the categories of the authorized facilities, procedure, cases, and conditions for obtaining the permits will be established by the Government of the Russian Federation. The corresponding ordinance of the Government of Russia will replace the order of Rostechnadzor dated April 7, 2008, No. 212 “Concerning Approval of the Procedure for Organization of Work on Issuance of Permits Authorizing Operation of Power Installations.”
This will make it possible to form a modern regulatory framework that meets all the requirements of the current legislation in order to provide the corresponding public service and to switch to maintaining the register of issued authorizations in electronic form.
The permits authorizing the operation are and will be issued without charge. The permit of the state energy supervision authority authorizing the operation must be obtained before receiving or supplying voltage (thermal energy, heat carrier medium). The permits authorizing the operation are issued not when utility connection is carried out, but also when commissioning new or reconstructed heat supply facilities and heat consuming installations, as well as the facilities to be authorized in the sphere of electric power industry, which are not to have utility connection.
In addition, the federal law clarifies the concept “energy-receiving installation, energy-receiving device” used in the federal law “Concerning Electric Power.” Such installations (devices) include, among others, the devices that do not work in a centralized operational dispatch control system and are not listed by the operational dispatch control entity as facilities subject to such control.
The federal law comes into force on January 1, 2021.
